Agreement to Receive Text Messages
By providing your mobile telephone number and affirmatively opting into any SMS or MMS messaging program offered by Lawn Care Estero, you expressly consent to receive recurring automated and/or non-automated text messages from Florida Sunshine Lawn Care, doing business as Lawn Care Estero (“Lawn Care Estero,” “Company,” “we,” “our,” or “us”), at the mobile telephone number you provide.
Messages may include appointment confirmations, scheduling updates, estimate notifications, service reminders, weather-related scheduling changes, invoice notifications, payment reminders, customer support communications, lawn care tips, seasonal maintenance reminders, promotional offers, discounts, and other communications relating to our lawn care, landscaping, and outdoor maintenance services.
Your consent to receive SMS messages is voluntary and is not a condition of purchasing any goods or services or accessing our Website.
By opting into SMS communications, you represent and warrant that you are the authorized subscriber or customary user of the mobile telephone number provided and that you have the authority to provide consent to receive communications at that number.
Messaging Technology Disclosure
You acknowledge and agree that Lawn Care Estero may use automated messaging platforms, manual messaging systems, customer relationship management platforms, and other communication technologies permitted under applicable law to send SMS and MMS messages.
These technologies may include systems that qualify as an automatic telephone dialing system under applicable federal or state law where permitted.
Program Description
Lawn Care Estero operates customer communication and informational SMS messaging programs designed to provide customers with important information regarding requested services and ongoing lawn maintenance.
Messages may include appointment confirmations, estimate follow-ups, scheduling updates, technician arrival notifications, weather delays, billing reminders, payment confirmations, customer satisfaction surveys, responses to customer inquiries, promotional offers, seasonal lawn care recommendations, and other communications related to our services.
Message content and timing may vary depending upon your interactions with our Company, your communication preferences, requested services, and seasonal service availability.
Message Frequency
Message frequency varies depending upon your interaction with Lawn Care Estero, the services you request, appointment schedules, seasonal maintenance needs, and your communication preferences.
Subscribers may receive approximately two (2) to eight (8) messages per month; however, message frequency may increase or decrease depending upon scheduled services, customer requests, promotions, weather events, and operational requirements.
Message and Data Rates
Message and data rates may apply according to your wireless carrier’s pricing plan. Lawn Care Estero is not responsible for any charges, fees, taxes, or other costs imposed by your wireless carrier in connection with SMS messaging.
Opt-Out Instructions
You may opt out of receiving SMS communications at any time by replying STOP to any message received from Lawn Care Estero.
After submitting a STOP request, you may receive one final confirmation message confirming that your request has been processed. Following confirmation, no additional marketing text messages will be sent unless you provide new consent.
Supported opt-out keywords may include STOP, END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL, or STOP ALL, where supported by the messaging platform.
Opting out of marketing messages does not prevent you from receiving transactional or legally required communications relating to scheduled services, active accounts, billing matters, or other communications permitted by law.

Carrier Disclaimer
Wireless carriers are not responsible for delayed, failed, misdirected, or undelivered messages.
SMS delivery is subject to effective transmission by your wireless carrier and network availability. Messaging services may not be available on all wireless carriers, mobile devices, or geographic locations and may be modified or discontinued without notice.
Changes to Your Mobile Number
If you change, deactivate, disconnect, or transfer ownership of your mobile telephone number, you agree to promptly update your information with Lawn Care Estero or discontinue enrollment using your previous number.
The Company is not responsible for messages sent to reassigned, recycled, transferred, or otherwise reissued telephone numbers when you have failed to notify us of such changes.
Consent Records and Compliance
Lawn Care Estero maintains records of SMS consent and communication preferences in accordance with applicable federal and state laws, including the Telephone Consumer Protection Act (“TCPA”), CTIA Messaging Principles and Best Practices, wireless carrier requirements, and other applicable regulations.
Consent records may include your mobile telephone number, the date and time consent was obtained, the method of consent, the website URL or landing page where consent was collected, the disclosure language presented during opt-in, IP address, browser and device information, user-agent information, session details, and message history.
These records may be maintained by Florida Sunshine Lawn Care or its authorized service providers for compliance, auditing, recordkeeping, dispute resolution, fraud prevention, communication management, and legal compliance purposes.
Privacy and Data Use
Your participation in our SMS messaging program is governed by our Privacy Policy.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Furthermore, text messaging originator opt-in data and consent will never be sold, rented, leased, or shared with any third party for that party’s independent marketing or promotional purposes.
We may disclose your information only to trusted service providers that assist us in operating our business, including SMS platform providers, telecommunications providers, cloud hosting providers, website hosting providers, payment processors, scheduling software providers, customer relationship management providers, analytics providers, and compliance service providers.
These service providers are contractually required to use your information solely for the services they provide on our behalf and not for their own independent marketing purposes.
Program Modification or Suspension
Lawn Care Estero reserves the right to modify, suspend, or discontinue any SMS messaging program at any time, including changes to message content, message frequency, enrollment procedures, eligibility requirements, technical functionality, or supported keywords, subject to applicable law.
Disclaimer of Warranties
SMS messaging services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by applicable law.
Florida Sunshine Lawn Care does not guarantee uninterrupted availability, timely delivery, or error-free operation of any SMS messaging services.
Limitation of Liability
To the fullest extent permitted by applicable law, Florida Sunshine Lawn Care, its owners, officers, directors, employees, contractors, agents, affiliates, successors, assigns, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to participation in, or inability to participate in, any SMS messaging program.
To the fullest extent permitted by law, the Company’s aggregate liability arising from SMS messaging services shall not exceed One Hundred Dollars ($100.00).
Governing Law
These Mobile Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
